Rural Aid: Make A Bale Promotion
Terms & Conditions

  1. Acceptance of Terms and Conditions: Instructions and information on how to enter the promotion and the prizes form part of these Terms and Conditions.  Entry into the promotion is deemed acceptance of these Terms and Conditions.
  2. Promoter: The Promoter is Rural Aid Ltd (ABN 29 605 783 597), of 8 Colebard Street East, Acacia Ridge, QLD, 4110 Australia, telephone 13003270624.
  3. Promotion Period: Entry to the promotion is as follows:
  4. from 12:00am (AEST) on 09/05/2019 until 11:59pm (AEST) on 29/12/2019. All times referred to herein are in AEST, unless stated otherwise.
  5. Eligibility: Entry to the promotion is free. The promotion is open to residents of Australia only.
    The following people are not eligible to win prizes:
    1. Directors, managers, agents and employees of the Promoter and their immediate families; and
    2. Directors, managers or employees of agencies associated with the promotion.
  6. How to enter: To enter, entrants must complete the following steps during the Promotion Period:
    1. Visit the promotion website at https://makeabale.com.au and follow the prompts to the game;
    2. Play the game by tapping (with a mouse or finger) the screen/device when a grass image is shown to receive either 1 or 10 points. If the entrant taps the screen/device when a tumbleweed is shown then they will be deducted 5 points.
    3. The game is made up of levels. The entrant must achieve the required amount of grasses tapped to move to the next level.
    4. Entrants must answer any questions that are asked during game-play.
    5. The game is over when the entrant is shown the Results page. At this point the entrant must register their details to be able to win a prize. The entrant can view their stats, the Leaderboard and play again from this screen.
  7. Prizes: Any entrant that scores 120 or more in one game will win a prize. The prize is a Rural Aid cap worth $20. The entrant must have registered their details in order to be eligible for a prize. There are a total of 100 caps available in this promotion.
  8. Conditions of Prizes:
    1. A score of 120 or more must be achieved in one game
    2. Entrant must have registered their details.
    3. Maximum one prize per registered player

  11. For prizes won during this promotion:
    1. The prizes are subject to the entrant producing to the Promoter if requested identification acceptable to the Promoter. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant; and
    2. The Promoter's decision as to the result of the promotion is final and no correspondence will be entered into.
  12. Notification to prize winners: The Prize winners will be notified in writing and by telephone within forty-eight (48) hours of their identification. Prize winner identification will take place weekly on a Monday. Every Monday from 13/05/2019 – 30/12/2019 inclusive, the winners will be identified by the score achieved and, if they meet the conditions set in clause 8, then they will be notified that they have won a prize. The prize will be sent to them once they have confirmed their postal address.
  13. No right to transfer prize: Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
  14. Validity of entries: The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residents) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The decision to verify, validate or disqualify an entry is in the Promoter's absolute discretion.
  15. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  16. Computer system issues: No responsibility is accepted for late, lost or misdirected entries. The Promoter is not responsible for any problems or technical malfunction of any computer system, software or Internet difficulties, including any damage to an entrant's computer, resulting from participation in the promotion. Any cost associated with accessing or submitting an entry is the entrant's responsibility.
  17. Liability: Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  18. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use or taking of a prize, or participation in a prize.
  19. Delay or modification to conduct of the Promotion: Subject to obtaining the approval from the regulatory authorities where required, the Promoter reserves the right to delay or modify any aspect of this promotion if for any reason it is not capable of running as planned (including without limitation, by reason of infection by computer virus, bugs, tampering, fraud, technical failures, power failures or due to any other causes unforeseen or beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion) but only to the extent necessary to overcome the issue that is affecting the running of the promotion as planned.
  20. Changes to Terms and Conditions: If the Promoter reasonably considers that a change to these Terms and Conditions is likely to:
    1. Benefit entrants; or
    2. Be of no or immaterial detriment to entrants,

then subject to obtaining approval from the relevant regulatory authorities, the Promoter can make the change and may place a notification on the Promoter’s website https://www.ruralaid.org.au/

  1. Privacy: The Promoter collects Personal Information (“PI”) in order to conduct the promotion. Entry is conditional on providing this PI. By participating in the promotion, an entrant authorises the Promoter, and contractors and agents of the Promoter, to access, collect and use the PI collected about the entrant and disclose PI about the entrant to the Promoter and its contractors and agents (which may include disclosure to financial institutions, lawyers, auditors, IT service providers, mail service providers, marketing service providers, market research companies, selling agents, prize suppliers) and gaming and other regulators, for the purposes of:
    1. Conducting the promotion;
    2. Conducting market research;
    3. Providing the entrant with information about products and services of the Promoter. Such information may be provided electronically, or by contacting the entrant by telephone or other means, until such time as the entrant asks the Promoter not to provide further information;
    4. Publishing the initials & post-code of a prize winner on the Promoter’s website; and
    5. Disclosing the initials and post-code of a prize-winner to selected media outlets as well as the Promoter’s website.
  2. Failure to provide personal information: If an entrant does not provide the PI requested, the entrant cannot participate in the promotion and will not receive information about products and services of the Promoter. The Promoter’s Privacy Policy, available here Rural Aid Privacy Policy, contains further information about how an entrant may access and seek a correction of PI, how an entrant may opt out, how an entrant can complain about privacy related matters and information about how their complaint will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s PI to any entity outside of Australia.
